1. Who We Are

Virtual Muse Builder is a digital product created and operated by Zanklea Digital, based in Messina, Italy. These Terms & Conditions ("Terms") govern your access to and use of the Virtual Muse Builder web application (the "App") and any related sales pages, checkout pages, and communications (together, the "Service").

By purchasing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. What Virtual Muse Builder Is

Virtual Muse Builder is a browser-based tool that helps you build detailed text prompts describing a fictional AI character ("muse"), and then optionally send those prompts to third-party AI image generation providers — currently Replicate and OpenAI — using an API key that you provide and control.

The App does not generate images on its own. All image generation happens on the servers of the third-party provider you choose, using your own account and your own API key. We do not store, process, or have access to your generated images at any point.

3. License & Access

Upon successful payment, you are granted a personal, non-exclusive, non-transferable, lifetime license to access and use the App for your own personal or commercial projects. This is a one-time purchase — there is no recurring subscription fee for the App itself.

You may not resell, sublicense, redistribute, or share your access credentials with third parties. Each purchase is intended for use by a single individual or a single business entity.

4. Third-Party API Keys & Costs

To generate images, you must provide your own API key from Replicate and/or OpenAI. You are solely responsible for any costs, fees, or charges billed by these third-party providers as a result of your usage. Zanklea Digital has no control over, and assumes no liability for, the pricing, availability, performance, or policies of these third-party services.

Your API keys are used exclusively to make requests directly from your browser (or through a proxy that does not log or store your key) to the relevant provider. We do not collect, store, or have visibility into your API keys.

5. Acceptable Use

You agree to use Virtual Muse Builder only for lawful purposes. You may not use the Service to generate content that:

• Depicts, impersonates, or is intended to resemble a real, identifiable person without their consent;
• Involves minors in any sexualized or inappropriate context;
• Is unlawful, defamatory, harassing, or infringes on the rights of any third party;
• Violates the acceptable use policies of Replicate or OpenAI.

You are solely and fully responsible for the prompts you create and the content you generate using the Service. Zanklea Digital reserves the right to revoke access, without refund, for any use that violates these Terms.

6. Intellectual Property

The Virtual Muse Builder application, its design, code, copy, and branding are the property of Zanklea Digital and are protected by applicable intellectual property laws. Your purchase grants you a license to use the App — it does not transfer ownership of the App itself.

Any images you generate using your own API key and third-party providers belong to you, subject to the terms of service of the underlying AI provider (Replicate and/or OpenAI).

7. Refund Policy

We offer a 7-day, no-questions-asked money-back guarantee from the date of purchase. If you are not satisfied for any reason, contact us at support@zankleadigital.com within 7 days and we will issue a full refund.

After 7 days, purchases are considered final and non-refundable, except where required by applicable consumer protection law.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, error-free, or compatible with every device or browser, nor that any third-party AI provider will remain available, unchanged, or free of errors.

9. Limitation of Liability

To the fullest extent permitted by law, Zanklea Digital shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to costs billed by third-party AI providers, loss of data, or loss of business opportunity.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid for the Service.

10. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Italy, without regard to conflict-of-law principles. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Italy, except where mandatory consumer protection laws of your country of residence provide otherwise.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. Material changes will be reflected by an updated effective date above.
